This Privacy Policy (“Policy”) describes the information collected by or on behalf of the Regional Arts Commission of St. Louis (“RAC, “we,” “us,” or “our”) both online through our websites found at https://racstl.org/ and https://stlouisarts.org/ (each referred to as the “Site”) and offline, including but not limited to information collected in person at our offices, during events, sweepstakes, contests, fundraising activities, and other RAC-sponsored programs or initiatives. For purposes of this Policy, the Site and all offline activities and interactions where Personal Information is collected are collectively referred to as the “Services.”
This Policy also applies whenever it is referenced by a URL or presented in printed form, whether at our physical locations, during in-person events, or in connection with any RAC activity where this Policy is made available to you. This Policy does not apply to websites, pages, or platforms operated by RAC or its affiliates that do not display, link to, or otherwise reference this Policy. If you have questions or concerns about this Policy, please contact us as set forth below.
We may modify or update this Policy from time to time. Changes that in our sole discretion are material will be conspicuously posted on the Site or otherwise communicated to you. We do not ordinarily provide notice of a minor change. All changes will be effective immediately upon posting to the Site.
We may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly with you (“Personal Information”) when you use our Services. The Personal Information we collect falls into three categories: (1) information you provide to us, (2) information we collect through automated methods, and (3) information we collect from other sources, each further detailed below. We will collect, use, and disclose such Personal Information pursuant to this Policy and applicable law.
Information You Provide to Us
We collect Personal Information that you provide directly to us. This may occur in the following ways:
Donation & Payment Data: If you make a donation, you may be required to submit your contact and billing information. We use a PCI-compliant payment processor, Blackbaud, to help facilitate donations. RAC does not receive your full credit or debit card number or other financial information when you make a donation, and such information is provided directly to the applicable payment processor. However, we receive information about your donation or purchase, such as donation amount and your contact information. When you register for an event or purchase tickets, you will be directed to a third-party website, such as Eventbrite, and such payment is subject to that third party’s privacy policy.
Programs: You may be required to submit certain Personal Information to get involved with, apply to, or register for certain programs, including events, grants, and to volunteer with us.
Contacting Us: If you contact us, including when you use the contact form on our Site, we will collect and use your name and contact information and any additional Personal Information you provide in your message, if applicable.
Sweepstakes and Contests: When you participate in sweepstakes, contests, or similar promotions offered through our Services, you may be required to provide certain Personal Information, such as your name, contact details, and any other information necessary for entry or prize fulfillment. We collect and use this information to administer the promotion, communicate with participants, and comply with applicable laws. Please note that additional terms and conditions may apply to your participation in these activities, and we encourage you to review those terms carefully before entering.
Social Media Interaction: When you interact with us through our social media platforms, we may collect certain Personal Information that you choose to share, such as your username, profile information, comments, likes, and any other content you post or send to us. This information is used to respond to your inquiries, engage with you, and improve our Services. Please be aware that your interactions on social media platforms are also subject to the privacy policies and terms of use of those third-party platforms.
Data Automatically Collected
We may use automated technologies to collect Personal Information from your computer system or mobile device when you use our Site. This may include the following:
Cookies & Other Tracking Technologies. We may use cookies (as small text files stored on your device when you visit our Site), web beacons, pixel tags, and other tracking technologies (collectively “Tracking Technologies”) on our Sites and in our email and other electronic communications with you. Most browsers automatically accept Tracking Technologies. For information on how to opt out of certain cookies and Tracking Technologies, please see Section 9.
In general, we may use essential cookies, functionality cookies, and performance/statistics cookies. The Tracking Technologies on our Site may collect information such as:
- IP addresses assigned to the computers and other devices you use;
- your internet service provider;
- device ID number;
- approximate geographic location;
- browser type;
- Site pages visited;
- websites you access before and after visiting the Site, and
- data related to how and when you use the Site.
We use Tracking Technologies to: (i) make our Site function properly; (ii) provide personalized experiences; (iii) tailor our interactions with you; (iv) help with our marketing efforts; (v) provide us with valuable data and statistics about the usage and effectiveness of our Services (including conversion tracking) and to help us improve our Services; and (vi) help us improve our services.
Google Analytics. We use Google Analytics to collect and process information about your use of the Site. Google sets Tracking Technologies on your browser or device, and then your web browser will automatically send information to Google. Google uses this information to provide us with reports that we use to better understand and measure how users interact with our Site. Embedded Content. Our Sites may contain embedded content that is provided by third parties, such as videos and music APIs. RAC and those applicable third parties may collect data about how you interact with such content.
Data From Other Sources
We may obtain Personal Information from other sources, and we may combine that Personal Information with other data we may already have.
We use Personal Information that we collect for the following purposes:
As Stated or Agreed to at the Point of Collection. We may use Personal Information for the purposes stated or agreed-to (or as is obvious) at the point of collection. For example, we use Personal Information to process your donation, respond to your questions, comments, or complaints. We may also use Personal Information as otherwise requested or consented to by you.
Administration. We use Personal Information for administrative purposes, such as to facilitate donation transactions, to inform you of our mission and the programs we provide, to manage and provide our grants, and to understand the Services’ demographics and user preferences.
Services Management. We use Personal Information for Services management, such as troubleshooting problems, improving the content and functionality of the Services, statistical and other analyses of the Services, and to customize the Services to you and our other users.
Business Analytics. We use Personal Information for business analytics purposes, including consumer and operations research, to assess the effectiveness of our Services and online services.
Advertising and Communications. We may use Personal Information to send you advertising materials, to notify you of events, new features of our Services or programs, to notify you of changes to our website or this Policy, and for other similar communications. We may use third parties or service providers to deliver communications to you. If you provide your email address to us, we may send you emails about our business, your interactions with us, and other marketing emails. To Protect Our Rights. We may use Personal Information to protect our legal rights or interests, or those of other parties, including to bring a legal action against you or anyone who may be causing harm to us, our Services, or to other users of the Services. We may also use Personal Information to seek business, financial or legal advice, and to respond to other legal requests.
Create Aggregated and De-Identified Data. We may process Personal Information to create deidentified and aggregated data in accordance with applicable laws. Any such deidentified and aggregated data is no longer subject to this Privacy Policy. RAC is the sole and exclusive owner of such de-identified and anonymized information.
We will keep Personal Information for the period necessary to fulfill the purposes described in this Policy, unless a longer retention period is permitted or required by law. We take reasonable steps to delete the Personal Information we collect when: (1) we have a legal obligation to do so, (2) we no longer have a purpose for retaining the information, or (3) if you ask us to delete your Personal Information, unless we determine that doing so would violate our existing, legitimate legal, regulatory, dispute resolution, contractual, or similar obligations. We may also decide to delete your Personal Information if we believe it is incomplete, inaccurate, or that our continued storage of your Personal Information is contrary to our legal obligations or business objectives. When we delete your Personal Information, it will be removed from our active servers and databases; however, it may remain in our archives when it is not practical or possible to delete it.
We may disclose Personal Information to the following categories of third parties:
Affiliates. We may disclose Personal Information to our corporate subsidiaries, affiliates and with their respective officers, directors, employees, accountants, attorneys and agents in order to provide and improve the Services, and for approved marketing purposes.
Third Parties and/or Service Providers. When we engage vendors to assist with the features or function of the Services or our business, we may give access to Personal Information as necessary to perform the service for us. We may disclose Personal Information to third parties and/or service providers that provide services for us. For example, we may disclose Personal Information to vendors, contractors, and business partners to help us host and manage the Services, provide payment processing, improve the content and functionality of the Services, perform data analysis and statistical analysis, troubleshoot problems with the Services, and support or provide the security of the Services. We also may share your Personal Information with third parties that otherwise partner with us, third parties that are involved with our programs, events, and grants. In some cases, a third-party provider may interact with you directly in connection with our Services or our offerings. To the extent we do not receive, access, or store Personal Information that you provide to such third-party provider(s), such data collection is subject to that third-party provider’s privacy policies and/or applicable terms of use.
Government Officials / Law Enforcement. We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information: (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are advised to disclose Personal Information by our legal counsel, (iii) when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of, RAC or any other party, (iv) or as otherwise appropriate.
Professional Advisors. We may disclose Personal Information to our professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to RAC.
Subsequent Owner or Operator. We may transfer your Personal Information to a successor entity or an operator upon a merger, consolidation, acquisition, bankruptcy, dissolution, liquidation or other corporate reorganization, to a purchaser of all or a portion of our assets, or pursuant to a financing arrangement or co-promotional agreement. The Personal Information we have about you may be transferred to parties to the transaction.
Other. We may disclose Personal Information to third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).
We do not knowingly collect or solicit Personal Information directly from anyone under the age of thirteen (13). If you are under thirteen (13), please do not share any Personal Information about yourself with us through the Services. If you are a parent or guardian and become aware that your child has provided us with personal information, please contact us using one of the methods in Section 10 and we will work with you to address this issue.
We use commercially reasonable technical and organizational measures to help secure Personal Information against loss, misuse, and alteration appropriate to the type of Personal Information processed. You understand that no data transmission over the internet can be guaranteed to be 100% secure. While we strive to protect Personal Information, we do not guarantee the security of Personal Information and you provide Personal Information at your own risk.
The Services is intended for use in the United States. If you access the Services from outside the United States, please be aware that Personal Information may be transferred to, stored in, and processed in the United States, which may have different data protection laws than the country/region where you reside or are a citizen.
The Site links to, or may be linked from, websites not controlled by us. We are not responsible for third parties’ privacy policies or practices. This Policy does not apply to any third-party websites or to any data that you provide to third parties. You should read the privacy policy for each website that you visit.
Cookie and Tracking Technologies Opt-Out: You can control certain Cookies and Tracking Technologies. These features and options are browser and device specific and are not uniform. You may be able to disable Tracking Technologies by changing your browser settings, depending on your browser. You can usually find these settings in the options or preferences menu of your browser. You may also opt out from Cookie and Tracking Technologies using our Cookie banner, or one of the consumer online tracking choices industry self-regulating sites. If you choose to block Cookies and other Tracking Technologies, certain features of the Site may not work. Blocking or rejecting certain Cookies will not stop all of the tracking described in this Policy. You cannot disable all Tracking Technologies, such as those that are essential to the functioning of the Site.
Email Communications Opt-Out: You may choose to stop receiving certain email communications by clicking on the “Unsubscribe” link located at the bottom of any email we send to you. Please note that certain email communications that are transactional in nature (for example, a donation confirmation or event registration confirmation) may not contain an unsubscribe link or opt-out instructions.
